Terms of use

These terms are an agreement between you and LuxVibeWeb, who operate Pingle at https://pingleapp.co.uk. By creating an event, replying to an invitation, or otherwise using the service, you agree to them. If you do not, please do not use Pingle.

Nothing in these terms removes rights you have as a consumer under UK law. Where a term here conflicts with a right you cannot lawfully give up, that right wins.

Pingle lets you build an event invitation, share it as a link, and collect replies. That is the whole of it.

Where Pingle suggests food, games, activities or a schedule, those suggestions are generated automatically and are ideas, not advice. They are not checked by a person. They are not checked for allergens, for age-appropriateness, or for safety. Use your own judgement.

Pingle is free. There is no charge, no card, no trial, and no credits. In return, the service is provided as-is and as-available, without any commitment about uptime, and we may change or withdraw features.

Because you pay nothing, our exposure to you is limited as set out in clause 10. If Pingle stops working the day before your party, you have lost the convenience of our software — which we would be sorry about — but you have not lost anything you paid for.

If we ever introduce a paid feature, it will be optional, we will say clearly what it costs before you commit, and anything already created will keep working.

You can create an event without an account. When you do, we generate a private host link that grants full control of that event, and email it to you if you gave us an address.

• Anyone holding your host link can manage your event and read your guest list. Keep it to yourself. Share the guest link with guests, never the host link.
• If you did not give us an email address, that link is the only way back in. We cannot recover an event for you if you lose it and we have no way to reach you. Please do not ask us to — we would have no way of knowing the event was yours.
• If you create an account, keep your sign-in details secure. You are responsible for what happens under your account.
• You must be 18 or over to create an event or an account.

When you add someone to a guest list, you are putting another person's details into our service. By doing so you confirm that:

• You have a genuine reason to invite them, and a reasonable expectation they would want to hear from you.
• You will not use Pingle to send unsolicited marketing or bulk messages to people who did not expect to hear from you.
• Where you add a child's details, you are their parent or guardian, or you have that person's permission.
• You will tell your guests what your event involves, and keep them safe while they are there.
• You will handle what your guests tell you — allergies especially — carefully, and will not share it beyond what your event needs.

You are responsible for the accuracy of everything you put into an event, including the date, the time, and the address. We do not check any of it.

To the fullest extent the law allows, we are not liable for any allergic reaction, illness, injury or loss arising from allergy or dietary information being missing, incomplete, inaccurate, delayed, not delivered, or misunderstood. Clause 10 sets out what we cannot and do not exclude.

You must not use Pingle to:

• Send spam, chain messages, or bulk unsolicited email.
• Impersonate anyone, or create an event you have no connection to.
• Harass, threaten, defame or bully anyone.
• Post content that is unlawful, obscene, or harmful to children.
• Collect other people's data for a purpose unrelated to your event.
• Sell tickets, take payments, or run a commercial event without telling us (see below).
• Probe, scrape, overload, reverse-engineer or attempt to break the service, or access data that is not yours.
• Circumvent any limit, check or security measure.

Business use. If you use Pingle in the course of a business, you additionally accept that you are the data controller for your guests' data under UK data protection law, that you are responsible for having a lawful basis for contacting them, and that the consumer protections in these terms do not apply to you. Please contact us before doing so.

We may suspend or remove an event, or close an account, if we reasonably believe this clause has been breached. Where it is proportionate to do so, we will tell you why and give you a chance to respond.

Everything you put into Pingle stays yours. We claim no ownership of your event details, your guest list, your photos or your words.

You give us permission to store, copy and display that content only so far as we need to in order to run the service for you — showing your invitation to your guests, emailing it, and generating your printable invite. That permission ends when the content is deleted.

The Pingle name, logo, design and software are ours. You may not copy or reuse them.

We aim to keep Pingle running but we do not promise it will be available at any particular time. It may be unavailable for maintenance, or because something we depend on has failed.

We may add, change or remove features. We may stop offering the service entirely. If we plan to shut it down, we will give hosts with an account or a registered email at least 30 days' notice and a way to export their data.

We may update these terms. If a change materially affects you, we will give reasonable notice by email where we can reach you, or by a notice on the site. Continuing to use Pingle after a change means you accept the updated terms.

Subject to that, and to the fullest extent the law allows:

• Pingle is provided as-is and as-available. We give no warranty that it will be uninterrupted, error-free, or fit for a particular purpose beyond what the law requires.
• We are not liable for anything that happens at, or because of, your event. That includes injury, illness, allergic reaction, property damage, cost, or a dispute between you and a guest.
• We are not liable for a message failing to arrive, arriving late, or landing in a spam folder, whether by email, SMS or a messaging app. Delivery depends on networks and providers we do not control.
• We are not liable for a guest not replying, replying inaccurately, or turning up when they said they would not.
• We are not liable for loss caused by you sharing your host link, or by losing it.
• We are not liable for the accuracy, safety or suitability of any automatically generated suggestion.
• We are not liable for business losses. If you use Pingle for a business, we are not liable for loss of profit, revenue, custom, goodwill, opportunity, or anticipated saving.
• We are not liable for anything caused by an event outside our reasonable control.

Keep your own copy. Pingle is not a backup service. Export anything you would be upset to lose — every event can be exported to CSV or PDF from the event page.

If you use Pingle in breach of these terms and that causes us loss, or a claim by someone else, you agree to cover our reasonable losses, costs and legal fees arising from it.

If you are a consumer, this applies only where the loss was caused by your own breach, and only to the extent it is reasonable — it does not make you responsible for something that was our fault.

You can stop using Pingle at any time. Delete your events, and email privacy@pingleapp.co.uk to close an account. See the Privacy notice for what happens to your data.

We can end this agreement and close your access if you breach these terms, or if we stop offering the service. Where the law requires notice, we will give it.

• These terms, together with the Privacy notice and Cookie notice, are the whole agreement between us.
• If any part of these terms is found unenforceable, the rest continues to apply, and that part is treated as reduced to the extent that makes it enforceable.
• Not enforcing a term straight away does not mean we have given it up.
• You may not transfer your rights under these terms. We may transfer ours if Pingle is sold, and will tell hosts with an account.
• Nobody other than you and us has rights under these terms.
• These terms are governed by the law of England and Wales, and its courts have exclusive jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
